You can operate under the radar and get away with selling a certain
amount. It is just like the people who have a few chickens and sell
the eggs. If caught, you might get shut down or get a small fine.

FDA is federal, and normally is not involved here. You need to
check your local city, county, and state health regulations.

There is probably a break point somewhere in your state between
a kitchen level operation and a factory. A kitchen would need to
be inspected. A factory would need a permit.

Payola. Shelf space is sold to the highest bidder. You pay, you
get on the shelf.

You would be. You probably want some advice from an attorney and
a CPA on a business structure to try to protect yourself, and you
