Per Diem Question: Per Diem not needed

I am a newbie to consulting. I have a contracting company pu****ng the
per-diem into my hourly rate
when I live within 20 miles of the work site. They are doing this to
raise my per diem rate to an acceptable level.The contracting is
trying to assure me that there would be no problems with the IRS come
April 15, but it seems like a blatant violation of per-diem rules.
Has anyone experienced such a problem ? I haven't signed anything
thing regarding thing neither am I going to, looks like the
contracting firm is desperate to make a illegal buck... ?? Any
comments/ideas on what to do next ?
