It is the aggravated assault on a police officer that is key only
there was no aggravated assault on a police officer. The aggravated
assault was committed on me by vigilantes and I was had to take the
fall for my on brutal beating by Jackson police officers. Whenever the
police severely and brutally assault someone their only out is to
charge their victim with an assault against them in an attempt to
cover up the crime and that's just what happened. The true evidence
will show that I was beaten so badly that I had severe head trauma as
well as other injuries. As further evidence my noise that was kicked
in has never been fixed regardless of the do***ents we have obtained
from the University Medical Center in Jackson that states plastic
surgery was performed and I was happy with the noise fix when in fact
I have never had plastic surgery or any other surgery other than a
wisdom tooth being cut out. The medical records show that I was
treated when in fact I was thrown into a jail cell until I healed-up
without medical treatments. Whatever so-called evidence Hinds County
may have as to my so-called convictions is only proof of the crimes
that were committed against me. The FBI was called in to investigate
and took many pictures of me. I was had to sign up for several felony
charges while under duress that I did not commit and/or were actually
committed against me and while under threat of having to serve 25-30
years for the aggravated assault that was actually committed against
me. I was also had to sign an affidavit promising not to sue the City
of Jackson and any of the Police officers involved in my beating.
Severe and very violent crimes were committed against me and in 1998
Hinds County deputy Sheriff Donnie Newman attempted to put another
bogus aggravated assault charge on me that was reduced to simple
assault on a police officer when in fact Newman was not assaulted at
all. I was illegally sent to prison after being beaten down and held
on suicide watch in the Hinds County jail for about 20 months. I told
the lawyers that I was not a convicted felon and that that was all
illegal yet the public defenders refused to defend me and challenge
the prior so-called convictions. I have been abused and then re-abused
in these matters and justice has been obstructed to maintain the
government cover-up that my family and I have been illegally forced to
take the fall for. My rights have been violated and I should have the
right to challenge the so-called convictions and/or evidence. It
should have already been done but I am not a lawyer and I cannot make
the lawyers do their job and even more so while I am being threatened
and brutalized and railroaded to prison. Without the so-called new
trial that the Mississippi Supreme Court supposedly ordered I cannot
be exonerated and isn't that handy for government to remand it to file
while further abusing me. The so-called evidence of any prior
convictions must be challenged otherwise justice is obstructed. The
NCIC re****t does not show me as a convicted felon and does not show
any aggravated assault on a police officer or at least it didn't at
the time I received a copy of the re****t. I was maliciously prosecuted
to re-enforce prior so-called convictions that are illegal and I was
packaged and handed over to the state without due-process and in
violations of the Constitution of the United States of America. I pled
not guilty to being a convicted felon and not guilty to assaulting
Donnie Newman and I was threatened by lawyer de Gruy with being shot
by deputies and with having to remain on suicide watch if I spoke out
in court and I had already been beaten and abused on suicide watch for
so long. Justice has been obstructed and crimes have been committed
against me. Thank you.

Mr. Jones: MDOC computer records show that you have a 1976 conviction
from Hinds County for Aggravated Assault and that you served five (5)
years probation on this sentence. Even if you did not serve any
actual time in custody it is still considered a felony conviction. You
may contact either MDOC or the Hinds County Circuit Clerk to see if
there is a copy of your sentencing order available. However, because
the conviction is so old the record may have been sent to the State
Dept. of Archives and you may need to contact them.
Also, I remember that you previously asked about having the record of
your conviction which was overturned expunged. I recently ran across
Miss. Code Ann. § 99-15-26(4) which allows a defendant to petition the
court to "expunge the record of any case in which an arrest was made,
the person arrested was released and the case was dismissed or the
charges were dropped or there was no disposition of such case." It is
in the discretion of the court whether or not to actually have the
record expunged.
