NO PURCHASE NECESSARY. PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
Please read these official rules before entering this Sweepstakes. By
submitting an entry, you agree to be bound by these rules and acknowledge
that you satisfy all Sweepstakes eligibility requirements.
1) PROGRAM ELIGIBILITY AND DESCRIPTION: This Sweepstakes is sponsored by
To****ba America Information Systems, Inc. ("Sponsor") and is open to legal
residents of the United States, except Florida and Puerto Rico who are 18
years of age or older as of date of entry and, if entering online, logging
onto the Internet from the United States. Employees of Sponsor, its
affiliates, subsidiaries, and anyone working on the product, project, or
promotion, and the advertising and promotional agencies and the immediate
family members of each are not eligible. This Sweepstakes will begin at
12:01 a.m. PT on November 11, 2008, and end at 11:59 p.m. PT on December
31,
2008 ("Entry Period"). No purchase is necessary to participate in this
Sweepstakes. All applicable United States federal, state, and local laws
apply. This Sweepstakes is void where prohibited or restricted by law.
2) HOW TO ENTER: To enter, go to
http://thesecretlivesofsnowmen.com/sweepstakes
and enter your email to be
automatically entered into the "THAT'S COOL!" sweepstakes.
Limit one (1) entry per person. Multiple entries submitted by a single
Entrant (whether or not using one or more email accounts or means of
entry)
are void. Sponsor assumes no responsibility for lost, late, garbled,
distorted, damaged or misdirected entries, or for any computer, network,
online, telephone, or human error or technical malfunctions that may
occur.
All entries become the property of Sponsor and will not be returned.
Entrant
will be asked to register by entering an e-mail address and submit entry
form electronically. With submission of entry, Entrant will receive
promotional or marketing-related emails from Sponsor. Entrant may opt out
of
receiving marketing communications from Sponsor by changing preferences on
Sponsor's Subscription Center page, by unsubscribing using the link on any
email received from Sponsor, or by replying to an email received from
Sponsor and putting the word "unsubscribe" in the subject or body of the
email.
3) PRIZES: (1) One To****ba Satellite® laptop will be awarded to the
sweepstakes winner. Approximate retail value (ARV) of the prize is
$599.99.
ARV is based on manufacturer's suggested retail price at the commencement
of
the Sweepstakes. Return of any prize/prize notification as undeliverable
may
result in disqualification and selection of an alternate winner. Taxes on
a
prize, if applicable, are the sole responsibility of each winner. Limit
one
(1) prize per person. Prizes are not redeemable for cash. Any and all
guarantees or warranties for merchandise prizes are subject to the prize
manufacturer's terms and conditions, and winners agree to look solely to
such manufacturer for any such warranty or guarantee claim. No
substitution,
barter, transfer, or assignment of any prize is permitted, except by
Sponsor
at its sole discretion. Some restrictions may apply. Sponsor reserves the
right to substitute a prize of similar or greater value if a prize is
unavailable.
4) WINNER SELECTION & NOTIFICATION: A random drawing will be conducted on
or
about January 5, 2009. Odds of winning depend on the number of eligible
entries received. Winner will be notified on or about January 15, 2009.
Winner may be required to execute an affidavit of eligibility and
liability/publicity release within seven (7) days from the date of
attempted
notification by Sponsor. If a selected winner is unreachable or
ineligible,
fails to claim a prize, or fails to return an executed affidavit in a
timely
manner, the winner will be disqualified and an alternate winner will be
selected. In the event of a dispute as to the identity of a winner based
on
an e-mail address, the winning entry will be declared made by the
authorized
account holder of the e-mail address submitted at time of entry provided
that such authorized account holder meets all the eligibility requirements
set forth in these official rules. "Authorized account holder" is defined
as
the natural person who is assigned to an e-mail address by an Internet
access provider, on-line service provider or other organization (e.g.,
business, educational, institution, etc.) that is responsible for
assigning
e-mail addresses for the domain associated with the submitted e-mail
address.
5) USE OF WINNER'S NAME, LIKENESS: Acceptance of prize constitutes
permission for Sponsor to use winner's name and likeness for advertising
and
promotional purposes without additional consideration or compensation
unless
prohibited by law. Winners further grant to Sponsor the right to use and
publish their proper name and state online and in print in any other media
in connection with the Sweepstakes.
6) INTERNET: The use of any automated launching or entry software or any
other mechanical or electronic means that permits the Entrant to
automatically enter repeatedly is prohibited. Sponsor assumes no
responsibility for any error, omission, interruption, deletion, defect,
delay in operation or transmission, communications line failure, theft or
destruction or unauthorized access to, or alteration of entries. Sponsor
is
not responsible for any problems or technical malfunction of any telephone
network or telephone lines, computer on-line systems, servers, or
providers,
computer equipment, software, failure of any e-mail or entry to be
received
by Sponsor on account of technical problems, human error or traffic
congestion on the Internet or at any Web site, or any combination thereof,
including any injury or damage to Entrant's or any other person's computer
relating to or resulting from participation in this Sweepstakes or
downloading any materials in this Sweepstakes. CAUTION: ANY ATTEMPT TO
DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF
THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH
AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER
REMEDIES FROM ANY SUCH PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO
THE
FULLEST EXTENT PERMITTED BY LAW.
7) WINNER LIST: The Sweepstakes winner list will be available on or about
January 15, 2008. You may request a winner list by mailing a
self-addressed
and stamped envelope accompanied with a signed request to "THAT'S COOL!"
Winner List, c/o To****ba America Information Systems. Inc, Building 1,
A115h, 9740 Irvine Blvd., Irvine, CA 92618. All requests must be received
by
February 28, 2009. Residents of WA and VT may omit return postage.

9) GENERAL RELEASE: BY ENTERING THIS SWEEPSTAKES OR ACCEPTING ANY PRIZE,
ENTRANTS RELEASE SPONSOR, ITS AFFILIATED COMPANIES, PRIZE DONORS, AND ANY
OF
THEIR DIRECTORS, OFFICERS, EMPLOYEES, REPRESENTATIVES, AND AGENTS FROM ANY
LIABILITY WHATSOEVER FOR ANY CLAIMS, COSTS, INJURIES, LOSSES, OR DAMAGES
OF
ANY KIND ARISING OUT OF OR IN CONNECTION WITH THIS SWEEPSTAKES OR THE
ACCEPTANCE, POSSESSION, OR USE OF ANY PRIZE, INCLUDING, BUT NOT LIMITED
TO,
PERSONAL INJURY, DEATH, DAMAGE TO PERSONAL PROPERTY, RIGHTS OF PUBLICITY
OR
PRIVACY, OR DEFAMATION, WHETHER UNDER A THEORY OF CONTRACT, WARRANTY, TORT
(INCLUDING STRICT LIABILITY AND NEGLIGENCE), PRODUCT LIABILITY,
CONTRIBUTION, OR ANY OTHER THEORY TO THE MAXIMUM EXTENT PERMITTED BY
APPLICABLE LAW.
10) GENERAL CONDITIONS: Entrant agrees to be bound by these official rules
and by the decisions of Sponsor and/or its judges, which shall be final
and
binding in all respects. To the maximum extent permitted by applicable
law,
Sponsor reserves the right to change these official rules or cancel,
modify
or suspend this Sweepstakes at any time, in its sole discretion. Sponsor
also reserves the right to disqualify any Entrant who tampers with the
entry
process, or to lock out persons whose eligibility is in question or who
have
