1. Eligibility
The New Jersey Life "Winners Circle" (hereinafter the "Sweepstakes") is
open
only to people who are twenty-one years of age or older as of the date of
entry. Employees of New Jersey Life, the sponsor, and any organization or
individual responsible for sponsoring, fulfilling, administration,
advertising or promoting the Sweepstakes or supplying the prize(s), their
respective cor****ate parents, subsidiaries, affiliated companies,
employees
and the immediate family members of such individuals are not eligible to
enter. "Immediate family members" shall mean parents, stepparents, child,
stepchildren, siblings, stepsiblings and spouses.
2. Sponsor
The Sweepstakes is sponsored by To****ba (hereinafter "the sponsor").
3. Cost of Entering
There is no cost to enter the Sweepstakes nor is there any requirement to
purchase any product or service from New Jersey Life or sponsor.
4. Sweepstakes Prize Odds
Odds of winning prize depend on the number of eligible entries received.
5. Agreement to Official Rules
Participation in the Sweepstakes constitutes the entrant's full and
unconditional agreement to comply with the Sweepstakes Official Rules.
Winning any prize in the Sweepstakes is contingent upon the entrants
fulfilling all requirements set forth herein in a timely manner.
6. Rules of Entry
a. Completed entry must be received by October 30, 2008.
b. Entrants must be eligible to enroll.
c. Only one entry per person will be accepted.
d. All taxes and gratuities that may apply are the responsibility of the
winner. Winner must sign a confirmation of eligibility and compliance
letter.
e. Winner will be notified of winning by certified letter. Winner has 30
days upon receipt to contact New Jersey Life. If winner does not contact
New
Jersey Life, another winner will be selected.
f. Winner may not assign, transfer, substitute, trade prize(s) to another
party. Prize(s) may not be redeemed for cash. If for any reason prize(s)
become unavailable, Sponsor may, at Sponsor's sole discretion, award a
substitute prize of equal or greater value.
g. All Federal, State and local laws and regulations apply. Void where
prohibited by law. Taxes and any other related expenses related to the
acceptance and/or use of the prize are the sole responsibility of the
prize
winner(s) who will receive a 1099 form reflecting the actual final retail
value of the price.
h. Winner will be selected on or about October 31, 2008 in a random
drawing
by Sponsor from all eligible entries received by New Jersey Life.
Sponsor's
selection will be final and binding on all matters relating to the
Sweepstakes. Each winner will be notified by certified mail and will be
required to sign and return an Affidavit of Eligibility and Release of
Liability, which must be returned to New Jersey Life within 21 days of the
date of notification, the failure to do so will cause a forfeiture of the
prize and an alternate winner will be selected by a random drawing.
i. Neither the Magazine or Sponsor shall be responsible for any lost,
stolen
or misdirected entries.
7. General
Sweepstakes is governed by the laws of the State of New Jersey with venue
in
Hunterdon County, NJ. By entering Sweepstakes, entrant agrees 1) to
release
New Jersey Life, Sponsor, and their agents from and against all liability,
loss or damages arising out the entrants participation in the Sweepstakes,
including the awarding, recipient, acceptant, use and or misuse of the
prize(s); 2) to be bound by the Terms and Conditions and Official Rules;
3)
to be contacted by New Jersey Life or Sponsor by telephone and/or mail;
and
4) if selected as winner, allow New Jersey Life and Sponsor to use his/her
name and likeness for advertising and promotional purposes in all media
including online, without any additional compensation except where
otherwise
prohibited by law.
